By creating an account, continuing as a guest, or otherwise using GCLEX ("the App"), you agree to these Terms of Use. If you do not agree, do not use the App.
GCLEX is a study aid for nursing students preparing for the NCLEX-RN examination. Content in the App — including questions, rationales, drug information, lab values, and clinical scenarios — is provided for educational purposes only and does not constitute medical advice, diagnosis, or treatment. Always follow your instructors, clinical preceptors, and current clinical guidelines in real practice. GCLEX is an independent product and is not affiliated with, endorsed by, or sponsored by the National Council of State Boards of Nursing (NCSBN). NCLEX-RN® and NCLEX® are registered trademarks of NCSBN.
You may use GCLEX as a guest, in which case your progress is stored only on your device, or you may create an account with an email and password, or via Google or Apple sign-in. You're responsible for keeping your password and email account secure. We may suspend or terminate accounts that abuse the service (e.g. attempting to bypass rate limits or paywalls).
GCLEX offers optional Plus and Pro subscription tiers. Where billing is enabled, subscriptions are processed by Stripe, renew automatically for the selected period (monthly, semester, or yearly) unless cancelled at least 24 hours before the renewal date, and can be managed or cancelled at any time from your account settings. Prices are shown at checkout and may change with notice. Refunds are handled on a case-by-case basis and are not guaranteed. At this stage of the product, billing infrastructure may be running in test mode — no real charges are made unless explicitly stated at checkout.
The AI Tutor, AI voice mode, and AI-generated question sets ("AI Features") are produced by a third-party large language model (served via Google Gemini), not by a licensed nurse, physician, or NCLEX-RN content reviewer. By using an AI Feature, you acknowledge and agree that:
We aim for clinical accuracy but the App is a large, evolving content bank; some content may not yet have been reviewed by a nurse educator. Report suspected errors so we can correct them. Do not rely on GCLEX as your sole source of truth for exam-day content.
Don't scrape, redistribute, or resell App content; don't attempt to reverse engineer the AI proxy or circumvent rate limits or entitlement checks; don't use the App to harass others or upload unlawful content via the AI Tutor's image attachment.
THE APP AND ALL AI FEATURES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ACCURACY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR THAT CONTENT (INCLUDING AI-GENERATED CONTENT) IS CORRECT OR COMPLETE. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE, OUR OWNERS, AND OUR THIRD-PARTY PROVIDERS ARE NOT LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP OR RELIANCE ON ANY CONTENT IN IT — INCLUDING EXAM OUTCOMES, ACADEMIC OR PROFESSIONAL CONSEQUENCES, OR ANY ACTION TAKEN IN CLINICAL PRACTICE BASED ON APP CONTENT. WHERE LIABILITY CANNOT BE FULLY DISCLAIMED, OUR TOTAL AGGREGATE LIABILITY IS LIMITED TO THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR $50, WHICHEVER IS GREATER.
You agree to indemnify and hold us harmless from any claim, loss, or damage arising from your use of the App in a way that violates these Terms — including using AI Feature output as actual medical, nursing, or clinical guidance rather than exam-prep study material.
You must be at least 13 years old to use GCLEX. By using the App, you represent that you meet this requirement. GCLEX is intended for nursing students and is not directed at children.
These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules.
Binding arbitration. You and GCLEX agree to resolve any dispute arising out of or relating to these Terms or the App through final, binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court, except that either party may bring an individual claim in small claims court if it qualifies. Arbitration will be conducted in English and take place in, or be based on written submissions from, the county where you reside unless you agree otherwise.
Class action waiver. Disputes must be brought on an individual basis only — not as a plaintiff or class member in any purported class, consolidated, or representative proceeding. The arbitrator has no authority to conduct any arbitration as a class action.
Opt out.You may opt out of this arbitration agreement by emailing the App's support contact within 30 days of first accepting these Terms, stating that you decline to arbitrate. Opting out does not affect any other provision of these Terms.
If you believe content in the App infringes your copyright, send a notice identifying the work, the allegedly infringing material, and your contact information to the App's support contact and we will investigate.
If any provision of these Terms is found unenforceable, the rest remain in full effect and the unenforceable provision will be modified to the minimum extent necessary to make it enforceable. These Terms, together with the Privacy Policy, are the entire agreement between you and GCLEX regarding the App.
We may update these Terms as the product evolves. Continued use after a change constitutes acceptance of the updated Terms.
